Agreeing to these terms
These Terms of Use ("terms") are an agreement between you and us. By creating an account or using WorldBestSong, you agree to these terms, including the content rules. Our Privacy Policy explains how we handle personal data. If you don't agree, please don't use the service.
Accepting these terms online creates a valid contract (for example under section 10A of India's Information Technology Act, 2000).
These terms are written in English. If you'd like them, our Privacy Policy or our content rules in Hindi or another language listed in the Eighth Schedule to the Constitution of India, email support@worldbestsong.com and we'll send you a translation.
Who can use WorldBestSong
- Anyone can browse songs, charts and reviews without an account.
- To create an account you must be at least 18 years old and able to enter into a binding contract. When you sign up, you confirm that you are.
- WorldBestSong isn't meant for children. If we learn that an account belongs to someone under 18, we will delete it.
- Parents and guardians who think their child has an account can contact our Grievance Officer.
- You can't use the service if the law where you live doesn't allow you to.
Your account
- You can sign up with a username, email address and password or, where available, with your Google or Apple account.
- Give accurate information and keep it up to date. One person, one account. Don't create an account for someone else, and don't pretend to be someone you're not.
- Your username and display name are public. Don't choose one that impersonates someone, uses someone else's trademark, or is offensive.
- Keep your password secret and don't reuse it from other sites. Don't tick "Keep me signed in" on a shared device. You are responsible for what happens under your account. If you think someone else has used it, email support@worldbestsong.com straight away.
- If you sign in with Google or Apple, that company handles your password, and its own terms apply to your Google or Apple account.
- You can't yet reset a forgotten password or change your username or email yourself. Email support@worldbestsong.com and we'll help once we've checked the account is yours.
- Don't sell, transfer or share your account.
- Privacy rights and nominations: to use your privacy rights, or to nominate someone to use them for you if you die or become unable to, email privacy@worldbestsong.com from your account's email address (or tell us whether you sign in with Google or Apple) and give your username. These are the details we need to identify you. See Your rights in our Privacy Policy.
Your reviews and ratings
"Your content" means the ratings, reviews, display name and bio you post. You own your content.
The licence you give us
So that we can run the service, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, publish and distribute your content on and through WorldBestSong. For example, we show it on song pages, on your profile and in the charts, and it can appear in search engines and link previews. The licence also lets us make technical changes needed to show it, such as shortening a review in a preview.
The licence ends when you delete the content or your account. Copies may remain for a short time in our backups, and copies that others (such as search engines) have already made are outside our control.
- We won't sell your content or use it in advertising.
- We won't claim we wrote it, and we show it with your display name. We don't edit the words of your reviews. We may hide or remove them as described in How we moderate.
- Your ratings count towards song averages and the charts. When you delete a rating, it is removed from those numbers.
Your promises
- You have the right to post your content, and it follows these terms and the law.
- Your reviews are your own honest opinion. Don't post fake reviews, reviews you were paid or rewarded for, or ratings meant to manipulate the charts.
- Short quotes from a song are fine when you're discussing it. Don't post full lyrics, large parts of them, or other copyrighted material you don't have the right to share.
- Reviews are public. Don't include sensitive personal information about yourself or anyone else.
Content rules
You must not post, upload, publish, share, store, change or otherwise make available on WorldBestSong (including in your username, display name or bio) any information that:
- belongs to another person and that you have no right to share;
- is obscene, pornographic or paedophilic; invades another person's privacy, including their bodily privacy; insults or harasses anyone on the basis of gender; is racially or ethnically objectionable; relates to or encourages money laundering or gambling; is an online game that causes harm to users; or promotes enmity between groups on the basis of religion or caste with the intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads anyone about where a message came from, or knowingly and intentionally spreads misinformation or information that is clearly false, untrue or misleading;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, India's friendly relations with other countries, or public order; incites any cognisable offence; prevents the investigation of any offence; or insults another nation;
- contains a software virus or any other code, file or program that can harm a computer or its data;
- is an online game that has not been verified as a permissible online game;
- advertises or promotes (including by surrogate advertising) an online game that is not permissible, or any platform offering one; or
- breaks any law currently in force.
These rules cover all information, including text, images or other content made with AI tools.
Also, on WorldBestSong, don't:
- harass, bully, threaten or abuse anyone, post hate speech, or encourage others to do so;
- post someone else's personal information, such as their phone number, address or email;
- post spam, advertising, referral links or chain messages;
- manipulate ratings, likes or charts, for example with multiple accounts, bots or coordinated voting;
- post full or substantial song lyrics;
- scrape or copy the site in bulk, overload it, get around rate limits or security, or create accounts or post with automated tools;
- try to get into accounts or data that aren't yours; or
- use the service for anything illegal.
If you break these terms, our Privacy Policy or these rules:
- we may immediately suspend or end your access to WorldBestSong, remove or disable the content, or both;
- if the content breaks the law, you may face penalties or punishment under the Information Technology Act, 2000 or other laws; and
- where the law requires it (for example under the Bharatiya Nagarik Suraksha Sanhita, 2023 or the Protection of Children from Sexual Offences Act, 2012), we will report offences to the appropriate authorities.
How we moderate
WorldBestSong is a small, independent site. We don't check content before it is posted, but we act on reports.
- Who decides: a person (the site operator) reviews reports and decides what to do. We don't use automated tools to judge content. The only automatic limits are on how often a network or account can sign up, log in, add songs, post reviews or like reviews.
- What we may do: remove or hide a review or rating, clear a display name or bio, or suspend or close an account. We keep a private copy of removed content for 180 days, as Indian law requires, so we can restore it if a decision is reversed or give it to authorities who lawfully ask. A suspended account can't log in.
- Statement of reasons: when we act on your content or account, we'll email you at the address on your account. We'll tell you what we did and for how long; the facts behind it, including whether it followed a report; the rule or law involved; and how you can challenge the decision. We may skip this where the law doesn't allow it, or for spam.
- Challenging a decision: reply to that email or write to our Grievance Officer, and we'll look at it again. You can also go to court. In India you can appeal to the Grievance Appellate Committee (see below).
- Safety: if we learn of information suggesting a threat to someone's life or safety, we'll report it to the police or other relevant authorities.
- Legal orders: we remove content or share information when a court or an authorised government agency lawfully requires it.
Reporting content
Use the Report link under any review or on any profile, or email our Grievance Officer at grievance@worldbestsong.com. Tell us where the content is (a link), what is wrong with it, and your name and email. Please report only in good faith. For copyright, see our copyright page.
Copyright and repeat infringers
Respect other people's rights. Our Copyright & takedowns page explains how to report infringement and how to respond if your content is removed. It follows India's Copyright Act, 1957 and the US Digital Millennium Copyright Act.
We close the accounts of repeat infringers. An account that receives 3 valid copyright notices that aren't successfully challenged will be closed, and we may act sooner in serious cases.
Music services and other third parties
Song details and artwork come from Apple (the iTunes Search API and Apple Music charts), Deezer and, for some older songs, Spotify. 30-second previews are provided courtesy of iTunes. We use Spotify's and YouTube's APIs to find links to songs on those services. Song pages link to Spotify, Apple Music, YouTube, YouTube Music, Amazon Music, Deezer, TIDAL, SoundCloud, JioSaavn and Gaana. We don't host any music.
- WorldBestSong is not affiliated with, sponsored by or endorsed by any of these services. Their names and logos are trademarks of their owners.
- Apple, Apple Music and iTunes are trademarks of Apple Inc., registered in the U.S. and other countries.
- Song details, artwork and previews belong to their owners and are provided "as is". They may be incomplete or wrong.
- Artwork and previews are there to help you discover music. Previews play as streams only. Don't download or save them.
- When you follow a link to another service, its own terms and privacy policy apply.
YouTube
We use YouTube API Services to find YouTube and YouTube Music links. By using WorldBestSong, you agree to be bound by the YouTube Terms of Service. See also the Google Privacy Policy.
Spotify
We use the Spotify Platform to find Spotify links. For the Spotify Platform, the Spotify Service and Spotify Content:
- We make no warranties or representations on behalf of Spotify, and we expressly disclaim all implied warranties about the Spotify Platform, Spotify Service and Spotify Content, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
- You must not modify or create derivative works based on the Spotify Platform, Spotify Service or Spotify Content.
- You must not decompile, reverse-engineer, disassemble or otherwise reduce the Spotify Platform, Spotify Service or Spotify Content to source code or any other human-perceivable form, to the full extent allowed by law.
- We are responsible for WorldBestSong. Third parties, such as Spotify, have no liability for it.
- Spotify is a third-party beneficiary of these terms and of our Privacy Policy, and is entitled to enforce these terms directly against you.
Deezer
Content from Deezer (such as song details and artwork) is provided for your strictly private, non-commercial use within a family scope.
Our name, site and data
- The WorldBestSong name and logo, the site's design and code, and the charts and statistics we build from users' ratings belong to us.
- You're welcome to share links and quote small parts with credit. Don't copy or reuse the site or its data in bulk, or use our name or logo to suggest we endorse you, without our written permission.
- Song details, artwork and previews belong to their owners. Reviews belong to the people who wrote them.
Disclaimers
- WorldBestSong is free and provided "as is" and "as available". To the extent the law allows, we make no promises (express or implied) that it will always be available, secure or error-free, or that song details, ratings, reviews, charts or links are accurate or complete.
- Reviews are the opinions of the people who wrote them, not ours.
- We may change, pause or stop all or part of the service at any time.
- Nothing in these terms takes away rights you have under laws that can't be changed by contract, such as consumer-protection laws where you live.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental, special or consequential losses, or for lost data, profits, goodwill or opportunities, arising from your use of (or inability to use) WorldBestSong;
- we are not liable for content posted by users or for third-party services and websites; and
- our total liability to you for all claims relating to the service is limited to ₹5,000 (or the equivalent in your currency), because the service is free.
Nothing in these terms limits or excludes liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.
Indemnity
If someone makes a claim against us because of content you posted, or because you broke these terms or the law, you agree to cover our reasonable losses and costs from that claim (including reasonable legal fees). We will tell you about the claim and give you a chance to respond. This doesn't apply to the extent the claim is our fault, or where the law where you live doesn't allow it.
Ending your account
- You can delete your account at any time in Settings → Delete account. This deletes your account, your ratings and reviews and your likes, and logs you out on all devices. It can't be undone. As Indian law requires, we keep your registration details (username, email, display name and join date) privately for 180 days and then erase them, and your username can't be registered again during that time. Some data can also stay in backups for a short time; see the Privacy Policy.
- We may suspend or close your account, or refuse access, if you break these terms or the law, if the law requires it, or if we stop running the service. Where appropriate, we'll tell you why (see How we moderate). If we close your account, you can't create a new one with the same email address or username for 180 days.
- If we shut the service down, we'll try to give reasonable notice on the site.
- The sections on your content licence (for content still on the site), disclaimers, liability, indemnity and governing law continue to apply after your account ends.
Changes to the service and these terms
- We may update these terms, for example when we add features (such as new sign-in options) or when the law changes. We'll change the "Last updated" date at the top.
- If a change is significant, we'll tell you before it takes effect, with a notice on the site and, where we can, by email.
- As Indian law requires, at least once every three months we remind signed-in users, with a notice on the site, of what happens if they break these rules (see the box under Content rules). At least once a year, and whenever these terms, our Privacy Policy or our content rules change, we also tell users about them.
- If a change needs your agreement, we'll ask you to accept it before you can keep posting or liking reviews. Otherwise, if you keep using WorldBestSong after a change takes effect, the new terms apply. If you don't agree, you can delete your account.
Governing law and disputes
- These terms are governed by the laws of India.
- Subject to the next point, the courts at [Your city, State], India have exclusive jurisdiction over disputes about these terms or the service.
- If you live in the European Union, the United Kingdom or another country whose laws let consumers bring claims in their home courts or rely on their home country's laws, you keep those rights. Nothing in these terms removes the mandatory protections of the law where you live.
- Nothing in these terms stops you from going to court or shortens the time you have to do so. We'd still appreciate the chance to fix a problem first, so please contact us.
