Copyright & takedowns
Effective · Last updated
We respect the rights of artists, songwriters and everyone else who creates. This page explains how to tell us about content on WorldBestSong that you believe infringes your copyright, and how to respond if your content was removed.
A few details on this page are still being finalised. For anything you need now, email support@worldbestsong.com.
Our approach
- WorldBestSong doesn't host music. Song details and artwork come from Apple, Deezer and, for some older songs, Spotify. Previews stream from Apple, and song pages link to music services.
- Users post ratings, reviews, display names and bios. We don't check them before they appear.
- We respond to notices under India's Copyright Act, 1957 and Copyright Rules, 2013 (rule 75), and the US Digital Millennium Copyright Act (17 U.S.C. §512).
- Short quotes in a review can be fair dealing or fair use. Please consider this before sending a notice.
Reporting copyright infringement
Email copyright@worldbestsong.com (or write to the address in Where to send notices). You can also use the Report link under a review. Your written notice should include:
- Your contact details: full name, postal address, phone number and email address. If you're acting for the copyright owner, say who they are.
- The work: a description of the copyrighted work you say is infringed, detailed enough to identify it.
- Your rights: details showing that you (or the person you act for) own the copyright or hold an exclusive licence.
- Where it is: the exact link(s) to the material on WorldBestSong, and for a review, the reviewer's username, so we can find it.
- Why it infringes: details showing the material is an infringing copy and not a use the law allows (for example under section 52 of India's Copyright Act, or fair use).
- Who posted it, if you know.
- Good faith: a statement that you believe in good faith that the use isn't authorised by the copyright owner, its agent or the law.
- Accuracy and authority: a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
- Court action (notices under Indian law): an undertaking that you will file an infringement suit in a competent court and give us that court's order within 21 days of our receiving your notice.
- Your signature: physical or electronic (typing your full name is fine).
If a notice is missing required details, we may not be able to act on it, but we'll try to contact you to ask for them.
Artwork, previews and song details
- Artwork and previews supplied by Apple: we forward complaints about them to Apple straight away, and remove any such content immediately if Apple asks. You can also contact Apple directly.
- Artwork and song details from Deezer or Spotify: tell us, and we'll stop showing the item and let the provider know.
- Links to music services (Spotify, YouTube and others) point to content hosted by those services. To have that content removed, contact the service that hosts it.
What happens next
- We acknowledge your notice within 24 hours.
- If the notice is complete, we remove or disable access to the material within 36 hours of receiving it. While access is restricted, we show a notice in its place explaining why. We keep a private copy so the material can be restored if the law allows or requires it.
- We tell the person who posted it what was removed and why, and may share a copy of your notice with them.
- Notices under Indian law (rule 75): we keep access disabled for 21 days from receiving the notice, or until we receive an order from a competent court. If no court order arrives within 21 days, we may restore access. After that, we don't have to act on another notice from the same person about the same work at the same location, unless it comes with a court order.
- Notices under US law (DMCA): the person who posted the material can send a counter-notice.
- We count valid notices against the account (see Repeat infringers).
Counter-notices
If your content was removed and you believe that was a mistake, or that you had the right to post it, email copyright@worldbestsong.com with:
- your physical or electronic signature;
- what was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you believe in good faith the material was removed or disabled because of a mistake or misidentification;
- your name, postal address and phone number;
- a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is or, if your address is outside the United States, any judicial district in which WorldBestSong may be found; and
- a statement that you will accept service of legal papers from the person who sent the original notice (or their agent).
What happens next (DMCA): we send a copy of your counter-notice to the person who complained. We restore the material 10 to 14 business days after we receive your counter-notice, unless that person first tells us they have filed a court action to stop the alleged infringement.
Notices under Indian law: send us your response too, and we'll take it into account. Under rule 75, the material stays blocked for 21 days or until a court decides.
Repeat infringers
We close the accounts of people who repeatedly infringe copyright. An account that receives 3 valid copyright notices that aren't successfully challenged will be closed. We may close an account sooner in serious cases. We keep a record of notices for each account so we can apply this policy.
False notices
Please don't send false notices or counter-notices. Under US law (17 U.S.C. §512(f)), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may have to pay damages, including costs and legal fees. False complaints can also have legal consequences in India. If you're not sure whether something infringes your rights, consider getting legal advice first.
